 (Brand Name: Rvaastu – Real Estate Services)

 

INTRODUCTION (VERY IMPORTANT – PLEASE READ CAREFULLY)


RRasal Connect Services Private Limited (RCSPL), operating under the brand Rvaastu, is a professional real estate service and brokerage company.

We assist:

 

Buyers in identifying and purchasing properties

Sellers in selling properties

Landlords and tenants for rental/lease transactions

Customers for new projects and redevelopment projects

 

👉 The moment you seek or receive any assistance from RCSPL (including property details, photographs, location, calls, WhatsApp messages, emails, meetings, or site visits), these Terms & Conditions automatically and legally apply, whether or not a written agreement is signed.

 

1. ROLE OF RCSPL (VERY CLEAR)

RCSPL is only a professional service provider and broker.

We:

 

Connect buyers, sellers, landlords, tenants, and developers

Coordinate meetings, site visits, negotiations, and communication

Assist in documentation and transaction coordination

 

We DO NOT:

 

Own any property

Act as a property owner or developer

Guarantee price, returns, approvals, or outcomes

 

Example:

 If RCSPL shows you a flat, shop, office, or land, the property belongs to the owner, not RCSPL.

 RCSPL’s role is limited to professional facilitation of the transaction.

 

2. BROKERAGE / SERVICE CHARGES (STRICT & COMPULSORY)

2.1 Sale / Purchase Transactions

Minimum brokerage: 2% of the total transaction value

 

Buyer pays: 2%

Seller pays: 2%

Brokerage is payable at the time of Agreement to Sell / Sale Deed / Registration, whichever is earlier

Applicable GST shall be charged extra, as per the law

 

Example:

Property Value: ₹1,00,00,000

Buyer Brokerage: ₹2,00,000

Seller Brokerage: ₹2,00,000

 

 

2.2 Rental / Lease Transactions

Brokerage: One (1) month’s rent per year

 

Payable by both Owner and Tenant

Brokerage is payable each time the lease is renewed

 

Example:

 Monthly Rent: ₹30,000

Brokerage: ₹30,000 from Owner + ₹30,000 from Tenant

 

On renewal next year → brokerage applies again

 

 

3. CUSTOMER’S RIGHT TO LEGAL VERIFICATION (FULL RIGHT, FIXED TIME)

Every customer has the absolute right to:

 

Verify all property documents

Check ownership, title, approvals, and encumbrances

Appoint their own advocate or legal advisor

Seek independent legal clarity

 

Verification Time Limit

All legal verification must be completed within 5 (five) working days from the date documents are shared

Any objection, doubt, or clarification must be raised within this period

 

Disclaimer

RCSPL / Rvaastu acts only as a facilitator

Objections raised after the confirmation or the delay period will not be entertained

The final decision and responsibility to proceed lies entirely with the customer

 

 

 

4. PAYMENT & EXECUTION TIMELINE

All financial arrangements must be completed within 15 (fifteen) working days of deal confirmation

Loan approvals (if applicable) must be obtained within this period

Any non-loan payments shall be made directly to the Seller

Agreement to Sell / Sale Deed must be executed and registered within this timeline

 

👉 Any delay caused by the customer, bank, government authority, or third party is not the responsibility of RCSPL / Rvaastu.

 

5. STRICT RULE – DO NOT BYPASS RCSPL

Once RCSPL:

 

Shares property details or photographs

Shares location or pricing

Arranges a site visit

Introduces buyer to seller/tenant to landlord

 

👉 RCSPL must remain involved till completion of the transaction.

You CANNOT:

 

Contact the owner directly behind RCSPL’s back

Negotiate or finalise the deal secretly

Register the property without RCSPL’s involvement

 

Example:

 If RCSPL shows a shop and you later deal directly with the owner to save brokerage, this is treated as cheating and bypassing.

 

6. DEAL CLOSED LATER OR THROUGH A THIRD PARTY

If a transaction occurs:

 

Directly or indirectly

Through relatives, friends, companies, or intermediaries

After weeks or months of introduction by RCSPL

 

👉 Full brokerage remains legally payable by BOTH parties to RCSPL.

Example:

 Property shown in January → deal closed in June directly

 ➡️ Brokerage is still fully payable.

 

7. FRAUD, CONSPIRACY & LEGAL CONSEQUENCES

If any customer:

 

Intentionally bypasses RCSPL

Conceals or misrepresents the transaction

Uses a third party to avoid brokerage

RCSPL reserves the right to:

File civil cases for money recovery

 

File criminal complaints for cheating and conspiracy

Recover:

Full brokerage

Interest

Legal expenses

Loss of business and time

 

 

8. NEW PROJECT / BUILDER PROPERTY RULE

If a customer visits a project through:

 

RCSPL executive, or

Rvaastu channel partner

 

👉 RCSPL must remain involved till booking and registration, even if:

 

Builder contacts the customer directly

Sales office follows up

Another broker approaches

Brokerage remains payable to RCSPL in all such cases.

 

9. PROFESSIONAL BEHAVIOUR – ZERO TOLERANCE

Customers must maintain professional conduct.

Strictly prohibited:

 

Abusive or offensive language

Threats or intimidation

Misbehaviour with staff

Physical or verbal harassment

RCSPL reserves the right to terminate service immediately and initiate legal action.

 

10. LEGAL ACTION FOR MISBEHAVIOUR

If a customer:

 

Abuses or threatens staff

Harasses executives

Attempts to damage RCSPL’s reputation

 

RCSPL may:

File police complaints

Initiate legal proceedings

Claim compensation for:

Mental harassment

Business loss

Legal expenses

 

 

 

11. INDEMNITY (CUSTOMER LIABILITY)

If a customer’s action causes

: Financial losses

Legal issues

Reputation damage

 

👉 The customer shall fully indemnify RCSPL for:

Lawyer fees

Court costs

Compensation

Interest and damages

 

 

12. LIMITATION OF RESPONSIBILITY

RCSPL is not responsible for:

 

False or misleading statements by owners/builders

Hidden legal defects were not disclosed by the customer

Delays by government authorities or banks

Hence, independent legal verification is mandatory for customers.

 

13. JURISDICTION

All disputes shall be governed by Indian Law and subject to the exclusive jurisdiction of the courts at Vasai, where RCSPL operates/is registered.

 

14. DEEMED ACCEPTANCE

Use of any RCSPL service, including:

 

Site visits

Calls or WhatsApp communication

Emails or meetings

 

➡️ Constitutes automatic acceptance of these Terms & Conditions, even without a signed agreement.

 

FINAL SUMMARY (FOR EASY UNDERSTANDING)

✔ Legal verification is your right and duty

 ✔ Brokerage is compulsory

 ✔ RCSPL must not be bypassed

 ✔ Misbehaviour is not tolerated

 ✔ Fraud or cheating leads to strict legal action

 

 

 

 

 

 

 

RESERVATION OF RIGHTS & CUSTOMER ACKNOWLEDGEMENT

RRasal Connect Services Private Limited (RCSPL)

 (Brand Name: Rvaastu)

By engaging with RCSPL / Rvaastu, the customer (buyer, seller, landlord, tenant, corporate, or institutional client) acknowledges and agrees as follows:

True & Complete Disclosure

 All information, documents, and statements provided to RCSPL (in hard copy or digital form) shall be True, accurate, complete, and lawful. Any false, misleading, or suppressed information shall be the sole responsibility of the customer.

 

Right to Seek & Verify Information

 RCSPL reserves the unrestricted right to request, verify, analyse, and seek clarification of any customer, financial, or property-related information required for security, compliance, or fraud prevention.

 

Obligation to Cooperate & Prove

 The customer shall promptly provide explanations or proof whenever required. Failure to cooperate may result in suspension or termination of services without liability on RCSPL.

 

Fraud Prevention & Disclosure

 If any misrepresentation, concealment, or suspicious activity is identified, RCSPL may retain records and share information with legal, financial, or regulatory authorities as required by law.

 

Indemnity

 The customer agrees to fully indemnify and hold harmless RCSPL from any loss, damage, claim, legal cost, or liability arising due to incorrect or incomplete information provided by the customer.

 

No Liability of RCSPL

 RCSPL shall not be responsible for consequences arising from customer non-disclosure, false information, or hidden defects.

 

Deemed Acceptance

 Use of any RCSPL service (calls, WhatsApp, emails, meetings, site visits) constitutes irrevocable acceptance of this clause, even without a signed document.

 

Governing Law & Jurisdiction

 This clause shall be governed by Indian Law, with exclusive jurisdiction of courts at Vasai, Maharashtra.

 

 

One-Line Summary (Optional Use)

Providing false or incomplete information is a legal risk to the customer; RCSPL reserves full rights to verify, protect, and act.
