1. NATURE OF SERVICES – NO OWNERSHIP, NO GUARANTEE

RCSPL operates solely as a real estate service provider, facilitator, and intermediary.

 RCSPL does not own, control, manage, develop, guarantee, or validate any property, project, land, documentation, financial arrangement, or third-party commitment.

All property details, photographs, measurements, prices, availability, or legal representations are provided directly by owners, developers, promoters, and third parties.

 RCSPL is not liable for:

 

 • Incorrect or false information shared by owners/builders

 • Title defects

 • Hidden liabilities

 • Encroachments, litigation, or government restrictions

 • Change in pricing, terms, or availability

Customers must carryout independent legal verification and due diligence before entering into any transaction.

 

2. NO WARRANTY OR ASSURANCE – CUSTOMER RESPONSIBILITY

RCSPL does not provide any warranty, expressed or implied, regarding:

 • Legality or authenticity of documents

 • Approval status (RERA, municipal, government)

 • Construction quality

 • Project timelines

 • Builder credentials

 • Loan eligibility or bank processing

 • Returns on investment or appreciation

3. LIMITATION OF LIABILITY

Under no circumstances shall RCSPL or its directors, employees, channel partners, or representatives be responsible for:

 • Any financial loss

 • Delay or failure of registration

 • Builder default or non-performance

 • Bank loan rejection/delay

 • Non-availability of property

 • Disputes between buyer–seller or tenant–owner

 • Miscommunication by any party

Maximum liability of RCSPL, if ever imposed by law, shall not exceed the brokerage amount received, and even that only after completion of due legal process.

 

4. NO DIRECT DEALINGS / ANTI-BYPASS DISCLAIMER

Once RCSPL shares:

 • Property details

 • Photos/videos

 • Location

 • Ownership details

 • Introduces buyer to seller/tenant to landlord

 • Arranges site visit

➡️ Customers are strictly prohibited from engaging in direct dealings or bypassing RCSPL.

Any transaction done behind RCSPL’s back—directly, indirectly, through relatives, friends, or associates—shall be treated as intentional breach and cheating, and full brokerage becomes legally recoverable with interest, penalties, and legal expenses.

RCSPL reserves full rights to:

 • Initiate civil action for money recovery

 • File a criminal complaint for cheating, conspiracy, and fraud

 • Claim damages for loss of business and reputation

 

5. BEHAVIOURAL CONDUCT DISCLAIMER

RCSPL follows a zero-tolerance policy towards:

 • Abuse (verbal or written)

 • Threats

 • Intimidation

 • Misbehaviour

 • Harassment

 • Defamation (spoken, written, online, or offline)

In such cases, RCSPL may immediately:

 • Terminate services

 • File police complaints

 • Initiate criminal defamation and harassment proceedings

 • Claim compensation for mental harassment and business loss

 

6. DATA PRIVACY & COMMUNICATION DISCLAIMER

RCSPL collects only the minimum information required to provide services.

 Information may be shared with property owners, buyers, sellers, tenants, bankers, legal experts, or project representatives only for service-related purposes.

RCSPL is not responsible for:

 • Leakage/exposure caused by the customer’s device, email, WhatsApp, or negligence

 • Hacking or cyber incidents beyond reasonable security measures

All communication with RCSPL may be recorded for verification, legal, and service-quality purposes.

 

7. NO AGENT, EMPLOYEE, OR THIRD-PARTY AUTHORITY

Only RCSPL’s authorised representatives have permission to speak or negotiate on behalf of RCSPL.

 RCSPL is not liable for:

 • Misrepresentation by unauthorised persons

 • Claims made by individuals falsely projecting themselves as RCSPL agents

 • Wrong communication by any third party

Customers must verify identity before sharing personal or property information.

 

8. INDEMNITY – CUSTOMER MUST PAY FOR LOSSES

Customers agree to indemnify (compensate) RCSPL fully for any:

 • Legal action

 • Lawyer fees

 • Court fees

 • Penalties arising out of:

 • Misconduct

 • False statements

 • Breach of terms

9. NO COMMITMENT UNTIL REGISTRATION

No deal is considered concluded until:

 • Payment is made

 • Agreement is signed

 • Registration is completed

RCSPL is not responsible for cancellation, price change, withdrawal of property, or disagreements between parties.

 

10. FORCE MAJEURE (UNCONTROLLABLE EVENTS)

RCSPL is not liable for failures caused by events beyond its control, such as:

 • Government actions

 • Court orders

 • Natural calamities

 • System failures

 • Strikes

 • Builder or bank delays

 

11. JURISDICTION

All disputes shall fall exclusively under the jurisdiction of the Vasai Courts, Maharashtra, India.

 

12. DEEMED ACCEPTANCE

By requesting property details, communicating with RCSPL, taking a site visit, receiving photos/videos, or using any Rvaastu service—
